Vape Mail Final Rule Issued - What You Need To Know!

On October 21, the United States Postal Service issued its Final Rule regarding the delivery of vape products through the US Postal Service. This ends months of speculation about what they might or might not choose to do - but as you'll see, there are really no surprises here. Spoiler alert: we're still going to be able to get your products to you!

Some quick background, first: the Preventing Online Sales of E-Cigarettes to Children Act ("POSECCA") amended the PACT Act to add all Electronic Nicotine Delivery Systems to the definition of "cigarette" for the purposes of whether they could be sent through the mail.

The USPS took eight months to accept comments and make considerations before making its narrow final ruling: that all vaping products, whether they contained nicotine or not, were subject to the limitations of the PACT Act. This means that all vaping products, including those containing synthetic nicotine, cannot be mailed through the USPS. There is a system of exceptions for B2B sales, but it is arcane and is intentionally designed by Congress to be incredibly difficult.
